AssalamualaikumMy question is if my father who works in an interest based bank gifts me like a land or a flat is it ok for me to rent out the flat or to sell the land after few years? Will the money I get from it be halal for me JazakAllah khair
All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad, sallallaahu 'alayhi wa 'sallam, is His slave and Messenger.
Some scholars are of the opinion that what a person earns from his forbidden work is only related to his liability, not to the specific things acquired through it. Therefore, it is permissible to engage in transactions such as buying, selling, gifting, and others with him.
At-Taaj and Al-Ikleel reads, 'It was reported that Ibn Habeeb said: Whatever these workers bought in the markets and gifted it to you, you are permissible to eat it. Ibn Rushd said: The point of this is that only the seller and the person who gives the present are accountable for the forbidden transaction. The same ruling was attributed toIbn Mas'ood who said: “To you is safety, while upon others is sin.” In Al-Mudawwanah, it was said: ‘If you deposit dinars with someone, and he buys goods with them, you have no share in the goods; instead, your sole concern lies with the return of your deposited dinars.’
Based on this, it is permissible for you to accept the apartment or land as a gift from your father and make use of it by selling or renting it.
However, you are required to continuously advise your father to quit working in such a usurious bank, but you should advise him wisely and gently.
