Fatwa CenterHer husband is HIV-positive and refuses to use protection
Question
Assalamun alaikum, I'm from nigeria,my husband of 6 yrs is HIV+ and I'm -ve, Alhamdulillah. He has 6 children from his previous marriages and I don't have any child, yet I demanded he use protection to protect me from getting infected and he refused, I always lived in fear of getting infected and told him, which he said he will rather divorce me than to use protection, which I think he's being selfish, islamically can I just accept the divorce or stay and let him get me infected?
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.
If your husband is infected with this dangerous disease and you do not have children from him, then you are advised to accept the divorce. Hopefully, Allaah, The Exalted, will bless you with another husband with whom you will have children. For more benefit, please refer to Fatwa 86070.
