MY SON IN LAW DIVORCED MY DAUGHTER ON CELL PHONE FROM DUBAI TO PAKISTAN UNDER PRESSURE OF HIS PARENTS. HE SENT MY DAUGHTER FROM INDIA TO PAKISTAN AND ADVISED HER THAT HE WILL PROCESS VISA FOR MY DAUGHTER IN DUBAI AND WILL CALL HER TO DUBAI AND BOTH WILL LIVE TOGETHER. IN THE MEANTIME HE RECEIVED SOME THREATS FROM HIS PARENTS IN INDIA SO HE DIVORCED MY DAUTHTER ON PHONE THRICE. NOW HE NEEDS TO REVOKE. IS IS POSSIBLE BECAUSE HE DIVORCED UNDER PRESSURE OF HIS CRUEL PARENTS.
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger.
If a husband utters three divorces in one session, then divorce takes place as three divorces; in which case, his wife becomes irrevocably divorced from him according to the view of the majority of the scholars and this is the most preponderant opinion.
This is, of course, if the husband did not intend with the second and third divorce to confirm the first divorce, as in this case, it is considered as one revocable divorce.
However, some scholars are of the view that uttering three divorces in one session takes place as only one divorce in all cases; for more benefit, please refer to Fatwa 89798.
If the divorce is revocable, then the husband has the right to take back his wife before the end of her waiting period. But if her waiting period expired, a new marriage contract must be conducted while fulfilling the conditions of an Islamic valid marriage.
Besides, you should know that moral pressure does not prevent divorce from taking place unless one reaches the extent of coercion.
Finally, it should be noted that the parents have no right to oblige their son to divorce his wife if there is no sound reason to do so, and the son is not obliged to obey them in this case.
