When my husband and I married, we had the Imam on the phone who was out of state, 2 muslim male witnesses on the phone who were also out of state, my Wali was on the phone who was also out of state, and a Christian female who was physically present at the time of Nikah. Does that make my marriage void?
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger.
In order for the marriage contract to be valid, the woman’s guardian or his authorized person should be present during the marriage contract along with two witnesses in the same session. Therefore, this contract that took place over the phone is void.
Now if you want to contract your marriage in a valid manner, your guardian or his authorized person should be present along with two witnesses in the session of contract; for more benefit on the conditions of a correct marriage contract, please refer to Fatwa 83629.
