Question:
to be a automobile surveyor cum loss assesor for any of the insurance company. is it allowed in shariyat? a surveyor is an external professional not on the payroll of insurance company. he can work for several companies and he gets his fixed fees for the survey of the motor vehicle for which he is appointed as the surveyor by that specific company.he inspects the accidental vehicle and negotiates with the garage personnel and gives him the assessment for the parts to be replaced or repaired related to the description of accident as explained by the insured. the labour is given to the garage personnel as the conditions laid in the policy. based on the inspection the surveyor, he sends the report of the accidental car to the insurance company. later after the vehicle is repaired the vehicle is reinspected and again as to the parts allowed to replaced or repaired has been done as said. again surveyor sends the report for the parts replaced or repaired. then the insurance company pays the surveyor the fees according to the schedule. Tell me if to be a motor surveyor job is allowed by the shariat???? Also tell me that can we take a comprehensive insurance for our car?
Answer:
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.
We have already issued Fataawa 81425 and 82078 that it is not permissible to work in commercial insurance companies as this is helping in sin, so please refer to them.
The kind of work about which you inquired in the question is no different from the kind of work mentioned in the above Fataawa, whether the person is hired by the insurance company, like the employees or he is hired as a partner as in your case. The reason of the prohibition is the same, which is helping these companies in their work, and Allaah forbade this, as He Says (what means): {… but do not help one another in sin and transgression.}[Quran 5:2].
As regards your second question, commercial insurance is not permissible whether that is a third party insurance or fully comprehensive insurance, except when one is obliged by the government to do so, but in case one has a choice, it is not permissible.
Allaah Knows best.
