All perfect praise be to Allaah, The Lord of the worlds. I testify that there is none worthy of worship except Allaah and that Muhammad is His slave and Messenger.
An employee is obliged to abide by the working hours and stay at work until his working hours are over. If he is absent from work or leaves work before the end of the work day without permission, then he bears a sin for that, and part of his salary is unlawful to him in proportion to the work time that he missed.
Shaykh Ibn ʻUthaymeen was asked about an imaam of a mosque who did not come to prayer and delegated a more qualified person to lead the people in prayer. Does he bear a sin for being absent from the mosque sometimes? He answered, "It is not permissible for him to do so, and the salary that he receives is unlawful because he takes it in return for work while he does not do that work." [Liqaa' Al-Baab Al-Maftooh]
The fact that most employees do this does not change the religious ruling at all.
As for the money that your brother gives you, it is lawful for you to use it because your brother's salary is not all unlawful. Rather, what is unlawful is the part that he gets for the hours that he misses at work. Hence, his salary is mixed, part lawful and part unlawful. It is not forbidden to deal with such a person in money matters. The Muslims, ever since the time of the Prophet and until the present, engage with the disbelievers in buying and selling and other transactions though it is known that the disbelievers do not refrain from dealing with Riba (interest) and from other practices that are forbidden in Islam.
