Question:

i ll be a partner in cafe sell food and shisha and i ll be the chef for cooking food and we ll share only money of food not for shisha so that halal or makrouh or haram

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

It is not permissible for you to be a partner in a restaurant that offers Sheeshah (nargile/hubble bubble) because your partnership is considered as authorizing your partner to do this forbidden act and it is considered as financing it, and being content with evil and helping in it; all this is Islamically forbidden.

However, there are many means of lawful earnings, so you should fear Allaah and seek your provision from lawful resources. The Prophet sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) said: "Jibreel (Gabriel) inspired in my heart that no soul will die until it would have consumed its (designated) provision and completed its appointed time (i.e. it will not die until its predestined time for its death comes), so fear Allaah and seek you provision in moderation." [Al-Haakim]

If we presume that the partnership had taken place according to the terms that you mentioned, then the profit made from Sheeshah is forbidden, and the one who gets it is obligated to get rid of it by spending it on the general interest of the Muslims or giving it to the poor and needy. For more benefit, please refer to Fatwa 118590.

Allaah Knows best.
