All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger.
If a person dies and leaves behind a father, a mother, a wife, two daughters, a son, a brother, two sisters, and a nephew (son of brother) and he did not leave any other heir, then his father and mother get one-sixth of the inheritance each, as Allaah Says (what means): {And for one’s parents, to each one of them is a sixth of his estate if he left children.} [Quran 4:11] His wife gets one-eighth of the inheritance, as Allaah Says about the share of the wives (what means): {But if you leave a child, then for them [i.e. the wives] is an eighth of what you leave, after any bequest you [may have] made or debt.} [Quran 4:12] The brother, the two sisters and the nephew [son of the brother] have no share in the inheritance because they are prevented from having a share in the inheritance by the existence of the father and the son. Furthermore, the wife of the brother has no share in the inheritance because she is not an heir in principle.
Therefore, the inheritance should be divided into 96 shares, the father gets one sixth of it, which is 16 shares, the mother also gets one sixth, which is 16 shares, the wife gets one-eighth, which is 12 shares, each daughter gets 13 shares, and the son gets 26 shares.
Nonetheless, we advise you not to be preoccupied about a matter which has not yet taken place, and it might happen contrarily to what you think. It is known that the inheritance of a deceased person is divided amongst his live relatives (heirs), and it might be that you will be blessed with a daughter and not with a son, or that one of your heirs dies before you, in which case the division of the inheritance will change from the above-mentioned division.
Moreover, you should know that it is not Islamicly acceptable for the money to be divided amongst your heirs while you are still alive so that they will get their shares after you die.
Indeed, the Salaf (the scholars among the righteous predecessors) disliked the act of asking about things which have not yet taken place.
