Question:
I have disabled sister who is living with my mother and she has some money from the government as support for her disability and as I said she is disabled mentally which made her not able to manage her money and her day to day needs, so my mother is in control and manage her money and her needs, she is over 30 year old, also my mother has a support money from the government for her self, she keeps her money together with her daughter's one as they are living together. Now she wants to go to Hajj Insha Allah, so she is asking if she can just use the money she saved or she has to divide her money from her daughter's one to use her own for Hajj but this will be very hard to keep truck of all the individual money. Knowing my mother is in charge of all spending in the house as they live together in one house.
Fatwa:
All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.
The duty of this mother is to spend the money of her daughter only in what is beneficial for her. The mother is not allowed to use this daughter's money to perform Hajj. As for how to separate the money of her daughter from her own money, it should be done based on strong assumption if it is hard to do it accurately. However, if the money of the mother is sufficient to cover the expenses of her Hajj then she has to perform Hajj otherwise, she is considered as lacking ability to perform it and then the Hajj is not due on her.
Allah Knows best.
