Question:
I am Indian and stay in Al-Khobar (Saudi Arabia). This year I am intending to perform Hajj-Tamattu’, Insha Allah. With this intention I performed Umrah last Thursday, i.e. 01-Jan-2004. On Friday after Fajr prayer I, along with my wife, performed Tawaf-e-Weda, since we were leaving after Jumu’a’ prayer from Mecca back to Khobar. After coming here some one told me that I should not have performed Tawaf-e-Weda in this Umrah since my intention was to perform Hajj, and Tawaf-e-Weda will be performed in Hajj.
My question is weather performing Tawaf-e-Weda in this Umrah will effect my intention of Hajj-Tammattu’, if yes what should I do.

Fatwa:
All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.
There is no difference of opinion that Tawaf Al Wada’ is something lawful after having done Umrah. The difference of opinion is whether it is obligatory or not.
To be on the safe side, it is preferable for someone doing Umrah to perform it, and you did well by performing Tawaf Wada’ after the Umrah, when leaving Makkah.
We draw your attention, however, to the fact that as you travelled after Umrah to Al Khobar, that makes the Tamatu’ invalid.
Therefore, if you want to make Hajj-Tamatu’, you have to do another Umrah when you travel for Hajj and not travel after that a distance by which a person is allowed to shorten the prayers. You can make Hajj-Mufrad, or Hajj-Qariun, from the Miqat if you do not wish to perform another Umrah to be allowed to make Hajj-Tamatu’.
